Everything to gain and nothing to lose

As part of the "All to Gain and Nothing to Lose" promotion, if you have not used the protection within 5 years, a purchase credit equivalent to 50% of the price paid will be granted. Credit applicable on a minimum purchase of $1000 in the furniture, mattress and decoration departments. This credit must be used within 6 months of being issued. This document, together with your purchase invoice, sets out all the provisions of the Protection Plan (Plan), sold by the retailer and available to the Plan holder, as well as the obligations and services that will be provided by Comerco Services inc (Comerco) in respect of the product covered by the Plan. The Plan is administered by Comerco. Comerco deposits funds in a guarantee trust to cover future claims. This trust is also the beneficiary of a limited bond issued by an insurance company. Comerco agrees to:

  1. Repair at no charge or replace the covered product due to a manufacturing defect or if the product or any part directly related to its operation breaks down. The breakdown must occur under normal use, during the period of coverage of the Plan.
  2. Reimburse losses of frozen food following a covered breakdown. The maximum reimbursable amount per covered breakage is $125 for the freezer portion of a refrigerator with a limit of $250 for the total duration of the Plan. For a single freezer, the maximum reimbursable amount per covered breakdown is $250 with a limit of $500 for the total duration of the Plan. In such cases, Comerco will inform the Plan holder of the procedure to follow to obtain a refund.
  3. Repair damage caused by thermal stresses to glass-ceramic plates. Photos should be submitted to Comerco to determine if a technician visit is required. Damage must be confirmed by an authorized technician.
  4. Repairing rust damage on household appliances:
    • That prevent the product from working as designed;
    • Which affect washer tubs, dryer drums and dishwasher racks.
  5. Replace broken control buttons that prevent the product from working. Comerco will mail the button(s) to the Plan holder.
  6. Repair or replace, following a covered breakdown, items peripheral to the product including, but not limited to, remote controls, keyboards, mice, speakers, 3D glasses, and external hard drives supplied with the product. The coverage period for peripheral items begins at the expiration of the manufacturer's warranty specific to the accessory and expires at the end of the Plan coverage period. The limit is one (1) replacement for the duration of the Plan. Replacement will terminate coverage for those items.
  7. Replace the product when an authorized technician finds a fourth (4th) failure of the same major part during the Plan period.
  8. Repair the damage caused by the surge.
  9. Allocate one (1) preventive inspection during the duration of the Plan, at the request of the holder, according to Comerco's checklist. When the Plan covers several products, the preventive inspection is available for all products, during a single visit of the technician. The preventive inspection does not apply to computer products, peripherals, GPS, cameras, camcorders and office equipment.

General conditions

  1. This Plan is effective from the date of expiry of the manufacturer's combined parts and labour warranty period for the duration selected, as indicated on the purchase invoice, up to a maximum of :
    • Six (6) years from the date of taking possession for household appliances
    • Five (5) years from the date of taking possession for electronics
    • Four (4) years from the date of taking possession for computer products
  2. To be eligible for coverage under the Plan, the Covered Product must be purchased new and have a repair warranty of at least ninety (90) days. Breakdowns must be reported during the Plan's coverage period.
  3. Comerco may, at its sole discretion, decide to replace a product rather than repair it.
  4. The maximum value of a replacement is the price paid for the original product, as stated on the purchase invoice. This amount, excluding taxes, must not exceed $25,000. Please note that if the price of the replacement product is less than the price of the original product, the difference will not be refunded. The replacement will be made by an authorized Comerco retailer.
  5. Comerco's sole obligation shall be to provide a replacement unit in the manner set out in clause 13. in the event that :
    • the manufacturer's business ceases operations; or
    • the parts are no longer available; or
    • in any other circumstances where, at Comerco's discretion, repair is not contemplated.
  6. Upon replacement of the product or issuance of a credit, Comerco shall have fulfilled all obligations under this Plan and this Plan shall become null and void with respect to that specific product.
  7. Repairs will be performed by a service centre selected by Comerco. Products that had in-home service as part of the manufacturer's warranty will receive in-home service under this Plan. If in-home service is not available from the manufacturer in the area where the covered product is located, the Plan holder will be responsible for bringing and returning the product to the service centre identified by Comerco, or he/she may obtain a full refund of the Plan from the retailer. Service will be performed during normal business hours. If offered and depending on the availability of the service centre, service may be performed, upon request, during evenings or weekends. A safe and non-threatening environment must be provided, as indicated by the technician, in order to receive in-home service. The product in need of repair must be easily accessible to the technician.
  8. This Plan is valid for products intended only for domestic use in a single-family dwelling. Products installed in the common areas of a multi-unit dwelling are not eligible for this Plan. In the case of home-based businesses, only day care centres and private residential homes are eligible for coverage. Any other type of business is considered commercial and cannot benefit from this Plan. Commercial or rental use will render this Plan null and void and if no costs have been incurred by Comerco, the holder may obtain a full refund of the Plan from the retailer.

The following are excluded from the responsibility of

Damage caused :

  1. By the fact that the product has not been used in accordance with the manufacturer's recommendations for use or under conditions for which it was not designed.
  2. By external causes, rust (except as covered in clause 4.), insect or rodent infestation, misuse, improper installation, improper handling, modification, accident, shock, fall, chemical corrosion, damage during delivery or data transmission problems.
  3. Ingress of sand, liquid or moisture, unless the manufacturer explicitly guarantees the product to be submersible.
  4. By breakdowns subject to a manufacturer's recall procedure or service bulletin and repairs, replacements, parts and/or labour costs covered by a manufacturer's warranty or insurance policy.

The following products or components:

  1. Trim, control or dimming markings, cosmetic components, and products and/or parts that are covered under a manufacturer's warranty.
  2. The housing showing signs of warping or sagging.
  3. Any structural part or component whose failure or condition does not prevent the product from functioning as designed.
  4. Parts that in the course of normal use must be replaced or cleaned periodically such as, but not limited to, light bulbs, lamps, fuses, filters, batteries or ink cartridges. However, Comerco will pay for labour to replace a sealed battery that is not accessible to the Plan holder.
  5. Windows, adjustable legs and/or castors and handles that are damaged by external causes, as well as refrigerator slides and rails.
  6. Satellite dishes, cables, shelves, drawers and cleaning of windows and screens.
  7. Any product with an altered or non-existent serial number. In this case, the Plan becomes null and void, without refund.
  8. Phosphor burned into or onto the screen surface and replacement or repair of pixels not covered by the original manufacturer's warranty.

Other exclusions :

  1. Smells.
  2. Noise and performance of the product not caused by a breakage.
  3. Loss of use of the product as well as loss of income, wages and time caused by delays resulting from product breakdown, parts being out of stock or any other difficulty in the repair process.
  4. Loss or appropriation by third parties of data left in a product that must be repaired or replaced under this Plan. The owner is fully responsible for recovering the media of data belonging to him.
  5. Configuration, data loss and computer viruses, updates required by the device for its operation, as specified by the manufacturer. Software included with the device and data recovery from a broken device.
  6. Costs relating to the removal, delivery and reinstallation of a product or, in the event of a visit by a technician, the removal and reinstallation of a product that is not readily available to him.
  7. Repairs not authorised by Comerco. In this case, the Plan becomes null and void, without refund.
  8. If no defects are found or if repairs are refused by Comerco, the Plan holder will be required to pay the costs incurred, failing which the benefits of this Plan will be suspended until such costs are paid in full. The duration of the Plan will not be modified in any way in the event of a suspension of benefits.
  9. In the event of a breakage to a covered product that is part of a pair or set, Comerco's liability shall be limited to repair, replacement or credit equivalent to the purchase price of the product that suffered the breakage.

Obtaining service and other details

To get service

You can report the breakage by filling out the form at www.comerco.com or by contacting Customer Service at 1-877-710-4653. A photo of the product, the damage, the nameplate or a copy of the purchase invoice may be required.

Cancellation

Comerco may cancel this Plan at any time in case of fraud.

The Plan holder may cancel the Plan for any reason within thirty (30) days from the date of purchase of the Plan, if no claim has been made. The refund of the Plan will be made to the retailer who sold the Plan.

Privacy

The Planholder authorizes Comerco to provide the Planholder's name, contact information and any information in the Planholder's file held by Comerco to any third party wishing to offer a new Plan, to any subcontractor mandated by Comerco to provide services related directly or indirectly to the Plan and to any entity to which Comerco may assign, in whole or in part, its obligations under the Plan.

Transferable

This Protection Plan is transferable from one owner to another, free of charge, by completing the online application at www.comerco.com/transfertproprietaire
